Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Cypress Cooling Company LLC, a Louisiana limited liability company (“Cypress Cooling,” “we,” “us,” or “our”). By accessing or using cypresscooling.com (the “Site”), requesting an estimate, or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
You must be at least 18 years old and able to enter into a contract to use the Site.
Who we are & what we do
Cypress Cooling is a family-owned heating and cooling company serving Metairie, Greater New Orleans, the Northshore, and the River Parishes of Louisiana. We provide residential HVAC services including air conditioning, heating, heat pumps, ductless mini-splits, ductwork, indoor air quality, and maintenance plans.
The Site provides general information about us and lets you request service, estimates, financing information, and employment. The Site is not itself a service agreement, and using it does not create a service contract.

This disclaimer applies to the Site and its content only. Warranties for HVAC work we actually perform are addressed in your signed service agreement and by the applicable equipment-manufacturer warranties.
Limitation of liability
Limits on our liability for the Site
TO THE FULLEST EXTENT PERMITTED BY LAW, CYPRESS COOLING AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms limits liability that cannot be limited under Louisiana law (such as for gross negligence or willful misconduct), and this section does not change the terms of any signed service agreement.
Indemnification
You agree to indemnify, defend, and hold harmless Cypress Cooling and its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
Governing law & venue
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Subject to the arbitration agreement below, you agree that the exclusive venue for any permitted court action is the state and federal courts located in Jefferson Parish, Louisiana, and the United States District Court for the Eastern District of Louisiana, and you consent to personal jurisdiction there.
Binding arbitration & class-action waiver

Except for the carve-outs below, any dispute arising out of or relating to these Terms or the Site will be resolved by BINDING INDIVIDUAL ARBITRATION, not in court, under the Federal Arbitration Act. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator, in or near Jefferson Parish, Louisiana (or by videoconference).
CLASS-ACTION WAIVER: You and Cypress Cooling agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
30-DAY OPT-OUT: You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.
CARVE-OUTS: Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court.

Termination
We may suspend or discontinue the Site, or restrict your access to it, at any time and for any reason, without notice. The sections of these Terms that by their nature should survive — including intellectual property, your submissions, disclaimers, limitation of liability, indemnification, arbitration, and governing law — will survive termination.
General terms
- Severability: If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect.
- No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement: These Terms and our Privacy Policy are the entire agreement between you and Cypress Cooling regarding the Site and supersede prior understandings about the Site. A signed service agreement controls over these Terms for the work it covers.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after an update takes effect means you accept the revised Terms.
